독일 사회법에서는 “사회적 정의와 사회보장의 실현을 위하여 인간다운 생활을 보장하고, 인격의 자유로운 발전을 도모할 수 있는 제반조건을 창설하여, 가족을 보호하고, 생활에 필요한 생계를 유지하고, 생활상의 특별한 부담을 부조를 통해 예방 또는 제거하며(동법 제조), 동법 및 동법에 규정된 사회권(사회보장수급권)은 그 목적에 잉용되어야 한다(동법 제2조)”고 규정하여 이 권리들이 사회보장법 각칙을 통하여 급여의 조건과 내용 이 구체화 되었을 때에 비로소 청구권적 성격이 인정된다는 제한적 규정을 두고 있다.(전광석, 독일사회보장법론, p.30)사회보장권의 성질을 불완전하나마 구체적 권리로 보아, 국가가 사회보장실현 의무를 이행하지 않는 경우에 국가기관에 의한 헌법침해를 이유로 법적 책임을 물을 수 있다고 한다. 자세한 내용은 권영성, 앞 책 p.607 참조.
권리로서의 취약성이란 사회복지수급권이 그 보장에 대한 명문규정이 있음에도 불구하고 국민의 기본적이고 구체적인 권리로서 인정받지 못하고 있는 것은 그것의 구체적 실현을 위한 청구권을 행사할 수 없으므로 권리로서의 취약성을 가지고 있는 것이다.
